A radiologist and two major Maine health organizations are asking a judge to throw out a lawsuit filed by a couple who claim a failure to diagnose a blood clot led to a devastating stroke. The legal action, brought by Jeffrey Sayward and his wife, targets MaineHealth, Spectrum Healthcare Partners, and a radiologist involved in Sayward's care.
According to the complaint, the defendants missed signs of a blood clot during a medical examination. The couple argues that this oversight directly caused Jeffrey Sayward to suffer a disabling stroke, which has permanently altered his quality of life and required extensive medical treatment. The lawsuit alleges negligence and a breach of the standard of care expected from medical professionals.
In response, the defense has filed a motion to dismiss the case. Their legal arguments center on the claim that the plaintiffs have not provided sufficient evidence to prove that the radiologist or the healthcare providers deviated from accepted medical practices.
